Confidential Settlement – Automobile Defect Injury

Wrongful death of a 68-year old woman who was killed in a 15 passenger van rollover accident which occurred in southern Illinois.  The case was filed in California against the manufacturer of the van and the rental agencies that leased the subject vehicle.  The lawsuit alleged multiple design defects affecting stability of the vehicle.  The case was settled during multi-party mediation in Los Angeles.  Litigation involved extensive use of investigators, mechanical engineers, and sophisticated digital animation.

$2,250,000 – Airline Negligence Injury

Represented a man who sustained crush injuries due to the negligence of Lufthansa German Airlines.  Litigation spanned three years, utilizing heavy use of architects, mechanical engineers, electrical engineers, accident re-constructionists, and animation graphics.  Twenty plus depositions taken in over five states.

$1,350,000 – Motor Vehicle v. Pedestrian Injury

Represented husband and wife clients who were struck by a motorist while walking in the parking lot of the Claim Jupiter restaurant. Both husband and wife sustained injuries to their lower extremities, requiring surgeries.  (No lawsuit filed)

$1,250,000 – Injury on Parking Lot Premises

Represented cab driver against a gas station and car wash owner for injuries sustained when he was struck by another cab driver who lost control of his vehicle while exiting the car wash.  Lawsuit alleged that Defendants failed to design the car wash premises with adequate room for parking as well as for exiting the car wash and navigating turns.  Litigation involved extensive use of architects, surveyors, and animation graphics.  Litigation costs exceeded $50,000.

$1,200,000 – Motor Vehicle Settlement

Represented a 44-year old woman whose vehicle was struck head on by another motorist who operated his vehicle across the center line of the roadway.  Defendants asserted the defense that Defendant had an unanticipated medical incident.  However, during discovery, it was determined that Defendant, a diabetic, had failed to monitor and maintain a normal blood glucose level, causing him to blackout while driving.  Of note, Plaintiff was taken to Good Samaritan Hospital following the accident where a physician placed a catheter in her subclavian artery instead of her vein, causing a stroke.  Litigation is ongoing against multiple medical Defendants.

$1,200,000 – Motor Vehicle Accident

Represented a young man who was a passenger in a vehicle whose driver made a left turn in front of an oncoming vehicle driven by an off-duty Chicago police officer.  The client sustained severe orthopedic injuries requiring two surgeries.  Driver of vehicle that client was a passenger in was uninsured.  Lawsuit was filed against Chicago police officer for his failure to reduce speed and keep a proper lookout.  Settled in litigation.

$1,000,000 – Head-on Motor Vehicle Collision

Represented a California man who was in Lincolnshire, IL for training with his company.  Travelling back from dinner, he and his co-employee were severely injured when the van they were riding in was struck head-on by another vehicle.  Case involved suing Plaintiff’s own insurance company in Chancery Court to force them to provide underinsured motorist coverage.  (Worker’s Compensation Carrier waived massive lien)

Injury: C5-C6 and C6-C7 disc herniation requiring cervical discectomy, cervical fusion and cervical instrumentation, placement of carbon fiber interbody cage, cancellous allograft and nerve ablation surgery

Injury: Central disc herniation/annular tear noted at L4-5, lumbar spondylosis, stenosis, diskogenic pain with radiculopathy which required decompressive laminectomy for later recess stenosis L4-5, posterior spinal fusion, intertransverse process arthrodesis L4-5 and transforminal limbar interbody fusion at L4-5

$525,000 – Motor Vehicle v. Pedestrian Accident

Represented a 65-year old gentleman who was struck by landscaping truck while he was attempting to cross the road.  Client sustained lower extremity fractures requiring surgery and 1-month nursing home rehabilitation.  Claim was originally denied by Rockford Mutual Insurance Company.  Defense alleged intoxication by Plaintiff and failure to keep a proper lookout.  Case involved use of accident re-constructionist.  Settled in litigation.

Settlement Amount: $495,000.00 (Policy Limits $500,000.00)

Injury: coma; bilateral facial fractures requiring multiple reconstruction surgeries; acetabular fractures; tibial fractures; clavicle fracture; rib fractures.

Specials: $1,106,329.68

$375,000 – Motor Vehicle Trucking Accident

Represented a woman whose vehicle was struck by a commercial truck when both vehicles changed lanes simultaneously.  Client sustained herniated disc requiring microdicsectomy.  Settled at mediation during litigation.

$250,000 – Motor Vehicle Accident

Client was a passenger in a cab when cab driver lost control of his vehicle.  Client sustained hairline hip fracture, no surgery required and full recovery after physical therapy three months later.  (No lawsuit filed)

Settlement Amount: $200,000.00

Injury: Cervical and lumbar herniation with a recommendation of surgical intervention for same; headaches.; 5 years later still treating and had not had the surgery.

$185,000 – Dog Bite

Represented a 12-year old boy who was bitten upon multiple areas of his body by a neighbor’s dog, sustaining puncture wounds and scarring upon his back and shoulder.  Settlement was structured with purchase of various annuities making full payment to child in an amount in excess of $300,000.

Injury: Medial Meniscal tear, left knee; Wedge Fracture at T-12; L5-S1 disc herniation and/or exacerbation of previously asymptomatic herniation

$175,000 – Hair Salon Negligence

Represented a 23-year old college student who sustained chemical burns upon the top of her head causing hair loss the size of a quarter for a period of one year.  Lawsuit was brought under the theory of misapplication of hair dye and/or failure to monitor application.  The case involved use of experts, a plastic surgeon, and dermatologist.  The case settled during litigation.

$165,000 – Trucking Accident

Represented a physician whose vehicle was struck by a commercial vehicle with injuries resulting in surgery.  The case settled at mediation during litigation.

$162,500 – Trucking Accident

Client sustained a torn rotator cuff when her vehicle was forced off the road by the Defendant’s 18-wheel truck. Defendants argued that no contact occurred between client’s and Defendant’s vehicle and that her injury was unrelated to the accident. The case settled during litigation.

$150,000 – Pedestrian Accident

Represented an elderly woman who was struck by a transportation van at O’Hare airport, sustaining a meniscus tear in her knee requiring surgery.  (No lawsuit filed)

$150,000 – Pedestrian Accident

Represented a 40-year old man who was struck by a valet parking attendant attempting to park a restaurant customer’s car.  Client sustained a meniscus tear of the knee requiring arthroscopic surgery.

$150,000 – Medical Negligence

Represented a 45-year old man who underwent unnecessary exploratory abdominal surgery for a questionable hernia.  It was later determined that Plaintiff had no hernia but in fact suffered from a condition known as intermittent porphyria, detectable by a simple urine test.  Unfortunately, Defendant doctor failed to order such tests until after Plaintiff’s surgery.

Settlement Amount: $115,000.00

PLAINTIFF HAD FALLEN 4 TIMES PRIOR TO THE DATE OF ACCIDENT.

Injury: Closed Fracture hip/pelvis; pain in joint hip/pelvic region; stiffness, weakness and spasms in the hip joint, Subluxation of left hip with loosing of cemented constrained liner
